Ticket Policy
LINCOLN POTTERS TICKET POLICIES
Our goal is to provide a fun, safe, professionally operated experience for every one of our fans. In order to create this atmosphere, the following policies will be enforced at all games:
Guests prohibited from carrying weapons of any kind, including guns and knives, into the stadium.
No outside food or beverage, including cans, bottles, ice chests, hard containers or thermoses will be allowed, regardless of contents.
No outside alcohol will be permitted.
No smoking will be permitted anywere within the gates of the stadium
No peddling or reselling tickets on stadium grounds or in the parking lot.
No refunds.
Any guest older than 2 years old must have a ticket to enter the stadium. Babies in arms must remains in the lap of their parent or guardian.
Gates open one hour prior to the start of the game on Friday, Saturday, Sunday, and ALL Fireworks Nights. Gates will open 30 minutes before game time on all Tuesday, Wednesday, and Thursday games.
NOT REDEEMABLE FOR CASH
No food, beverages, bottles, cans, containers, coolers, or other similar items are permitted inside the stadium and the User agrees to relinquish and forfeit any such items prior to entrance of the Host Venue or upon notice of security.
No weapons including guns and firearms are allowed on the premises of Historic McBean Stadium including concourse, parking lots, and surrounding area.
ALL GAME TIMES SUBJECT TO CHANGE
IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE; HOLDER ACCEPTS RISK OF ILLNESS/INJURY; NO RE-ENTRY PERMITTED. By using this ticket, the ticket holder (“User”) assumes all risk incidental to the game of baseball and events held at Historic McBean Stadium (“Host Venue”) and agrees to the following terms and conditions. These terms may be amended at any time without notice.
User consents to all searches and screening of User’s person, bags, clothing, or other articles for security purposes, by law enforcement officials, stadium security, and/or gate personnel before entering Historic McBean Stadium and while on the premises of the facility and/or its parking apparatus. The User agrees that such screening is a condition for admission to the stadium. The User agrees to act in an orderly manner and not to disrupt the game, event, or enjoyment of others, and to comply with all policies and protocols. User of agrees that the California Collegiate League, Lincoln Potters, McBean Food and Beverage, the visiting team and their respective designees may use User’s image, voice, and likeness in connection with any game or event broadcast, telecast, cablecast, webcast, or other media transmission as well as in any advertising or promotional use related to the game, the event, and/or collegiate summer league baseball. User consents to all such uses without further notice, consent, or compensation. Potters reserve the right to terminate the license granted by this ticket, without refund of any portion of the purchase price, and either refuse admission to, or eject User from, an event, if (a) the User violates the terms of this License, (b) is in possession of any dangerous or hazardous objects,(c) appears to be or is intoxicated, (d) engages in improper or disorderly conduct, (e) uses vulgar or abusive language, or (f) poses a risk to the health and safety of others.
ASSUMPTION OF RISK
User recognizes that attendance at any event is voluntary and may result in personal injury, death, illness and/or property damage. User agrees to abide by all policies and stay alert and remain aware of User’s surroundings. User acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in any event, whether any risk or danger occurs prior to, during or after the event, including but not limited to, the danger of being injured by thrown bats; bat fragments; throw/batted balls; thrown, dropped or launched items; projectiles; person; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. User agrees the Released Parties (defined below) shall not be responsible for any personal injury, death, illness, property, damage, or other loss suffered as a result of (c) User’s participation in, attendance at, and/or observation of any event and/or (d) the sole, joint, or comparative negligence, or strict liability, of the Released Parties (collectively, “Spectator Claims”). “Released Parties” include: (i) the Lincoln Potters; (ii) the California Collegiate League; (iii) past, present and future licensees, sponsors, and vendors, and their successors and assigns; (iv) any local or state government body associated with the Host Venue; (v) the ticket vendor and/or providers; and (vi) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, volunteers, partners, members, directors, officers, owners, agents, representatives, and/or independent contractors of such entities.
GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE
ON HIS/HER/THEIR OWN BEHALF, USER WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY THAT MAY ARISE IN CONNECTION WITH, OR RELATE TO, (A) THE USE OF THIS TICKET BY USER, (B) USER’S PRESENCE AT THE HOST VENUE; (C) USER’S PARTICIPATION IN ANY EVENT OR ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING ANY CLAIMS THAT ARISE AS A RESULT OF(I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING WITHOUT LIMITATION, ALL SPECTATOR CLAIMS; ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF ANY COMMUNICABLE DISEASE; ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO USER; AND/OR ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT TO PUBLICITY, OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OF ADVERTISEMENTS, CONTENT, PROGRAMS AND/OR MATERIAL IN WHICH RECORDING OR PHOTOGRAPHS OF USER FROM THE EVENT APPEAR (“RELEASED CLAIMS”).
USER FURTHER ACKNOWLEDGES AND AGREES THAT USER IS FAMILIAR WITH AND DOES HEREBY WAIVE THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE WHICH PROVIDES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT OT EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The acknowledgements and express assumptions of the risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and release of liability, and interpreted to be broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure of contraction of any communicable disease. If any part hereof is held to be invalid or unenforceable for any reason, the remainder of these terms and conditions shall remain valid and fully enforceable. BY ATTENDING/PARTICIPATING IN THIS EVENT, USER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES. IF MINOR(S) ATTEND THE EVENT WITH USER, USER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF SUCH MINOR(S).
POLICY FOR RESUMED OR RESCHEDULED GAMES/EVENTS: In the event of a game that does not become official, this ticket stub is your receipt for a future game, based upon availability. Postponed game tickets can be exchanged for a ticket of equal or lesser value. All changes must be done in person at the Lincoln Potters Box Office. Tickets may not be exchanged for fireworks games or any other game held in conjunction with concerts and special events. All exchanges are subject to availability. All game times are subject to change. All fireworks displays are subject to cancellation in the event of adverse weather conditions and/or time constraints and no part of the purchase price will be refunded.
ALL EVENT TIMES ARE SUBJECT TO CHANGE. POTTERS ARE NOT RESPONSIBLE FOR LOST, STOLEN, DUPLICATED, OR DESTROYED TICKETS.
NO SMOKING, VAPING OR ELECTRONIC CIGARETTES. MINORS MUST BE SUPERVISED AT ALL TIMES.
